Terms of Use

These Terms of Use govern your access to the Arkweaver website and service operated by Arkweaver, Inc. ("Arkweaver", "we", "us"). By using the service you agree to these terms. If you use the service on behalf of a company, you represent that you are authorized to bind that company.

The service

Arkweaver analyzes customer conversations and product data to identify feature requests, connect them to the people who asked, and produce related communications. We may change, add, or remove features over time, and will give reasonable notice of material reductions in functionality.

Accounts

You are responsible for the accuracy of your account information, for keeping credentials confidential, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

Your content

You retain all rights to the content you submit to the service. You grant Arkweaver a non-exclusive license to host, process, and analyze that content solely to provide the service to you. You are responsible for having the rights and consents needed to submit that content, including any notice or consent required to record and analyze conversations.

Acceptable use

  • Do not use the service unlawfully or to infringe the rights of others.
  • Do not attempt to gain unauthorized access to the service, other accounts, or our systems.
  • Do not reverse engineer, resell, or use the service to build a competing product, except to the extent this restriction is unenforceable by law.
  • Do not upload malicious code or interfere with the integrity or performance of the service.

AI-generated output

Parts of the service use large language models. Output may be inaccurate or incomplete and should be reviewed by a person before it is relied on or sent to a customer. Arkweaver is not responsible for decisions made solely on the basis of generated output.

Third-party integrations

The service connects to third-party tools at your direction. Your use of those tools is governed by their own terms, and we are not responsible for their availability, accuracy, or handling of your data.

Fees

Paid plans are billed as described in your order form or plan selection. Fees are non-refundable except where required by law or expressly stated in a written agreement with us.

Intellectual property

Arkweaver and its licensors own the service, including all software, models, designs, and trademarks. No rights are granted other than the limited right to use the service under these terms.

Termination

You may stop using the service at any time. We may suspend or terminate access if you materially breach these terms, or if required for security or legal reasons. On termination, your right to use the service ends and we will make your content available for export for a reasonable period.

Disclaimer

The service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, Arkweaver will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability arising out of or relating to the service will not exceed the amounts you paid to us in the twelve months before the event giving rise to the claim.

Governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules, and the state and federal courts located in Delaware will have exclusive jurisdiction over any dispute.

Changes to these terms

We may update these terms from time to time. Material changes will be posted on this page with a new effective date, and continued use of the service after that date constitutes acceptance.
